Reacţia Comisiei Europene la ordonanţa pe legile Justiţiei: Urmărim cu mare îngrijorare evoluţiile privind statul de drept. OUG încalcă recomandările MCV

Comisia Europeană a criticat miercuri adoptarea ordonanţei de urgenţă de modificare a legilor Justiţiei, despre care a spus că încalcă recomandările din MCV. Mai mult, un purtător de cuvânt al instituţiei a anunţat că Bruxelles-ul va cere explicaţii Guvernului de la Bucureşti.

„Comisia Europeană urmăreşte cu mare îngrijorare ultimele evoluţii privind statul de drept în România“, se arată într-o intervenţie a unui purtător de cuvânt al Comisiei Europene, Margaritis Schinas. De asemenea, acesta susţine că ultimele modificări făcute legilor Justiţiei prin ordonanţa de urgenţă adoptată marţi ar încălca recomandările Mecanismului de Cooperare şi Verificare. 

Mai mult, Comisia Europeană cere ca România să fie mai atentă şi să caute să facă paşi înainte, nu să regreseze, deşi în ultimii ani a făcut progrese.

The European Commission is following with great concern the latest development concerning the rule of law in Romania. Both the content and the procedure of the latest changes using emergency ordinances without any consultations with the judiciary and stakeholders seem to be in direct contradiction with the recommendations of the Commission under the Cooperation and Verification Mechanism, endorsed by all Member States. Therefore, the Commission will seek explanations from the Romanian government on the latest changes.

Let me remind you that our November report urges Romania to „put in place a robust and independent system of appointing top prosecutors, based on clear and transparent criteria, drawing on the support of the Venice Commission”. It also asks to “Revise the Justice laws taking fully into account the recommendations under the CVM and issued by the Venice Commission and GRECO”. The latest changes follow a different track.

As we said before, Romania needs to very urgently put the reform process back on track. This means going forwards, not backwards and abstaining from any steps which reverse the progress accomplished over the past years.
